JioKrishi App - Terms and Conditions

This Application is a mobile and/or web application made available by Jio Things Limited and/or its affiliates (“Company”, “we”, “us”), at 101, Saffron, Nr. Centre Point, Panchwati 5 Rasta, Ambawadi, Ahmedabad – 380006 (“App”). The App is owned and controlled by Jio Platforms Limited (“JPL”) and facilitates access to services provided by the Company. It is designed for use of the “JioKrishi Device”, an AI-powered IoT device, for: creating a data-driven farmer ecosystem; analysing soil conditions and irrigation needs of the farmer’s plot; providing educational videos; and helping farmers connect with agricultural experts (“Services”). Your use of the App is subject to these T&C, the Device terms available at the EULA, and the terms and privacy policy of your enterprise. This T&C is an electronic record under the Information Technology Act, 2000, published per Rule 3(1) of the IT (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, and requires no physical or digital signature.

Please refer to the Privacy Policy (App) for disclosures relating to collection and use of your personal information from using the App. You shall additionally be bound by the privacy policy applicable to the use of the Device.

Modification of T&C: The Company may change the T&C under which the Services are offered, including any charges; the T&C may be modified based on business, legal and regulatory changes and updated online, and you will be notified. Modification of Services: the Company may add, modify or delete any content or features at any time at its sole discretion.

The Services are intended solely to facilitate use of the Device. Unless otherwise specified, the App is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or Services obtained from the App.

The App may contain links to or feeds from other websites/applications (“Linked Sites”), which are not under the Company’s control; the Company is not responsible for their contents, links, changes or transmitted information, and inclusion of a link does not imply endorsement. Any content provided from a Linked Site shall be “U” rated (suitable for all ages). Any dealings with third parties (including advertisers and weather-prediction APIs) via a link, or participation in promotions — including delivery, payment and associated terms/warranties — are solely between you and the third party, and the Company is not responsible or liable for them.

You warrant not to use the App for any purpose that is unlawful or prohibited by this T&C, or in any manner that could damage, disable, overburden or impair the Services. You are not entitled to use any tools/mechanisms (software or hardware) that could interfere with the functioning of the App or its Services.

We may offer subscription plans on the JioKrishi App, subject to the applicable terms. Subscription Plans apply for a specified Subscription Term (month, quarter, six months, year, or as indicated). Plans are inclusive of applicable taxes and may be changed at the Company’s discretion. Multiple payment options may be offered; the Company may add or delete any mode without prior notice. You may renew manually or via auto-renewal; if you opt for auto-renewal, the Company may notify you at least two (2) days before automatically renewing using the same payment method, with cancellation instructions. If you do not cancel before the renewal date, renewal is deemed opted and you will be charged at the then-applicable rates. The Company is not liable for loss/damage arising from lack of authorization, exceeding limits, payment issues, or declined transactions, nor for any credit/debit card fraud (the onus to prove otherwise is on you). You represent the card used is yours or authorized, and agree to provide correct card details; all cards are subject to validation by the issuer. You can access billing under “Order History”; you must report any obvious billing error within 5 (five) days, failing which you release the Company from liability for such error caused by slight negligence. Paid Services remain in effect until terminated/cancelled per clause 8.

This cancellation and refund policy, together with the T&C, sets out the Company’s procedures for cancellation and refund. By using the Services you agree to be bound by it. We may change the policy governing cancellation/refund of Subscription Plans from time to time. To the maximum extent permitted by law, subscriptions are non-refundable and non-cancellable; we do not provide partial or full refunds or credits in any scenario, and you may access the Services until the end of the Subscription Term. Any change/cancellation before expiry of the current term does not entitle you to a refund for the unexpired period. You may upgrade at any time; credit balance is calculated based on current plan value and past usage (days) and adjusted against the upgraded plan. (Example: a Rs 999 annual plan subscribed on 1 Jan 2023, upgraded on 10 Apr after 100 days used, gives a credit of Rs 725, so Rs 1774 is payable for the Rs 2499 Gold Plan, with expiry set to 9 Apr 2024.) Post cancellation, you may re-subscribe through the App.

THE COMPANY MAKES NO REPRESENTATIONS ABOUT THE COMPATIBILITY, SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS OR ACCURACY OF THE INFORMATION, SOFTWARE AND SERVICES, WHICH ARE PROVIDED "AS IS" WITHOUT WARRANTY; THE COMPANY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. THE COMPANY IS NOT RESPONSIBLE FOR UNAUTHORISED ACCESS/ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR FOR ANY THIRD PARTY'S INFRINGEMENT. THE COMPANY DOES NOT GUARANTEE COMPATIBILITY WITH ALL OPERATING SYSTEMS/PHONES/NETWORKS, AND USE MAY REQUIRE UPGRADES. REQUIREMENTS SUCH AS SUFFICIENT BATTERY AND NETWORK STRENGTH ARE YOUR SOLE RESPONSIBILITY. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE PROVISION OF OR FAILURE TO PROVIDE SERVICES OR INFORMATION OBTAINED THROUGH THE APP, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE OR STRICT LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY.

The Company may blacklist, disable and terminate a user from further using the App or its Services. If the Company disables your account per the T&C (e.g. for violation), you may be prevented from accessing the App and/or Device, your account details and/or files or other Services stored with your account. The Company may, at its sole discretion, terminate your access to any or all Services at any time without notice, and may suspend and/or terminate access in case of non-adherence to these T&C.

Registration: to use the Services you must log in and authenticate for the first time using a valid mobile number or email via OTP; you promise to provide accurate, complete and updated registration information and may not transfer your account without our prior written permission. You agree to adhere at all times to the prohibitions in this clause. You shall not host, display, upload, modify, publish, transmit, update or share information that: belongs to another to which you have no right; is obscene, pornographic, paedophilic, invasive of privacy (including bodily privacy), insulting/harassing on the basis of gender, racially/ethnically objectionable, related to money laundering/gambling, an online game causing user harm, or promoting enmity between groups on religion/caste with intent to incite violence; is harmful to a child; infringes any patent, trademark, copyright or proprietary right; deceives/misleads about origin or is patently false/misleading (including content identified as fake by the Central Government’s fact-check unit); impersonates another; threatens the unity, integrity, defence, security or sovereignty of India or public order; contains viruses/malicious code; is an online game not verified as permissible; is advertisement/surrogate advertisement of a non-permissible online game; or violates any law. Use restriction: you must not access the App if barred or legally prohibited under Indian law. You are responsible for any third-party access/data fees. You may need to install Updates; use requires that you agree to automatically requested Updates. You agree the information you enter is true, current, complete and accurate; the Company is not responsible for losses from discrepancies or unauthorized account use. Agricultural Expert: the Service allows you to ask agricultural queries of an expert; your questions/content must conform to the prohibitions, and the Company may use your profile information and data against posted content, visible to all users including the expert.

The Company or all right holders in/of the App and/or your smart phone/tablet own title, interest and rights, including all related intellectual property rights. Such ownership includes all intellectual property rights arising from any suggestions, enhancement requests, recommendations or other information provided by the user, whether in the course of using the App, your smart phone/tablet or otherwise.

You authorize the Company to collect, retain and use information as per the privacy policy of the Company.

Severability: where any term is unenforceable under applicable law, it shall be severed and will not affect the other terms; the Company may substitute a suitable enforceable provision at its discretion. Governing Law and Jurisdiction: if a dispute arises regarding the Terms, the laws of the Republic of India will apply and be subject to the exclusive jurisdiction of courts in Mumbai. Dispute Resolution: all disputes shall be governed under the laws of India and subject to the jurisdiction of the courts of Mumbai only. Indemnity: you shall indemnify and hold harmless the Company, its owners, employees, licensees, affiliates, subsidiaries and group companies and their officers, directors, agents and employees from any claim, demand or action (including reasonable attorneys’ fees) or penalty arising out of your use of Jio Things Ltd services and/or breach of these Terms, privacy policy and other policies, or your violation of any law, rules, regulations or the rights of a third party.
