Device Warranty - Terms and Conditions

  1. Warranty

Jio Things Limited (“Company”) warrants its branded “IoT Devices” and components in the original packaging (collectively “Product”) with a limited warranty covering defects in materials and workmanship, applicable only when the Product is used normally and per the guidelines (Product information, technical specifications, user manuals, service communications, and the Quick Service Guide (QSG)) (“Defect”). The Product may include sensor(s), solar panel, data logger, battery and gateway; accessories may include stainless steel ring(s), mounting plate, U-clamp(s), nut bolts and pole. A Defective Product during the Warranty Period will be repaired or replaced free of charge upon a valid claim by the Customer (or authorized representative), provided the warranty is not void per Clause 3.1. “Customer” means an individual/organisation who purchased the Product from the Company and the authorized user. For removable/detachable Products, the Customer must present the Defective Product at an authorised service centre with the original invoice or proof of issuance. The warranty may be carried out by the Company or its authorized service partners/dealers, at the Company’s discretion, and the list may change from time to time (published at jiokrishi.com without prior intimation). TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND ITS REMEDIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES; THE COMPANY DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN/LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW.

  2. Warranty Period

This warranty of the Product and its components applies as stated in the Annexure. Elements covered under warranty carry a warranty for twelve (12) months commencing from the date of the original invoice or proof of issuance of the Product (“Warranty Period”).

  3. Limitations on the Scope of Warranty

This warranty shall not apply where a Defect arises from: inter-operability, playability or compatibility issues with external/non-compatible accessories, sensors, surveillance systems, apps, software, file systems, CODECs, signals or networks; abnormal use or use not described in the manual, improper storage, excessive moisture/temperature, unauthorised modification or repair (including unauthorised spare parts), abuse, accident, acts of god, spills, cosmetic damage, improper installation, wiring/connection damage, improper/unregulated power supply, or antenna breakage; failure to notify the Company of the Defect during the Warranty Period; removal/defacement/alteration of the Product seal, serial number or accessory date code; items not supplied/approved by the Company, not fit for use, or used other than intended; broken/tampered seals or use in unspecified equipment; operating outside QSG guidelines; unauthorised modification of functionality; normal wear and tear or aging; damage to plastic components (front/back cover, antenna, connector pins, accessories); restrictions/conditions from applicable law/regulations/industry standards; or signalling/connectivity issues attributable to the network provider. The Customer has no coverage for damages under Clause 3.1 conditions; in such cases the Company may repair on a chargeable basis. The Company’s decision on categorisation is final and binding. The Customer owes a fundamental duty of care; no Customer is authorised to open the Product, and any such action or resulting damage disentitles the warranty. The Company is not liable for injury or property damage due to incorrect installation/tampering. Theft-detection features do not constitute a guarantee or insurance against theft. The Customer must track equipment and contact customer care on non-working. The Customer is responsible for all data/content uploaded and for account/login confidentiality; the Company may access the account to respond to support requests. Subject to law, the Company may use/share Customer-generated Data (in anonymized form where used beyond providing services) with partners/affiliates/third parties for services, analysis, marketing and commercial purposes. If information provided is untrue/inaccurate/incomplete, the Company may suspend or terminate services. During the Warranty Period, a Defective Product may be repaired or (only for dead-on-arrival [DOA]) replaced in whole/part at the Company’s option; the Customer submitting a valid claim shall not be charged. Warranty on a repaired/replaced Product/part extends only for the remaining Warranty Period. Where permitted to post/upload, the Customer must ensure content is inoffensive and lawful, and shall not: defame/abuse/harass/threaten; impersonate or misrepresent affiliation; publish inappropriate/infringing/obscene/unlawful material; upload IP-protected material without rights; upload viruses/corrupted files; disrupt Website/Services access; attempt unauthorized access, probe/scan vulnerabilities, or reverse look-up other users; disrupt security; or collect/store data about other users. LIMITATION OF LIABILITY: EXCEPT AS PROVIDED AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY IS NOT RESPONSIBLE FOR ANY DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, REVENUE, BUSINESS, PROFITS, SAVINGS, OPPORTUNITY, GOODWILL, REPUTATION, LIFE, OR DATA) HOWSOEVER CAUSED. THE COMPANY DISCLAIMS ANY REPRESENTATION THAT IT CAN REPAIR OR REPLACE WITHOUT RISK OF DATA LOSS. THE CUSTOMER SHOULD MAKE PERIODIC BACKUPS; DURING SERVICE THE STORAGE MEDIA CONTENTS WILL BE DELETED AND REFORMATTED, AND THE COMPANY IS NOT RESPONSIBLE FOR ANY LOSS OF SOFTWARE, DATA OR INFORMATION. The Company may change its warranty service method and the Product’s eligibility; service options, parts availability and response times vary by state, and the Customer may bear shipping/handling if the Product cannot be serviced in that State. Warranty service is restricted to the country where the Product was originally delivered.

  4. Process for Availing Warranty

To avail the warranty for any Defect, the Customer must walk in with the Product (or part) and a valid claim to an authorised service centre of the Company, bring the Defective Product and collect it after service. On request, the Customer must provide the original Purchase Invoice with a valid claim. During the Warranty Period the Company or its authorized partners/dealers will repair or replace the Defective Product or part; the decision to repair or replace is at the Company’s sole discretion, and a valid claim is not charged. The Company may use new or refurbished/reconditioned parts equal to new in performance. After warranty service, the Product/replacement is returned as originally configured (subject to updates); the Company may install system software updates that prevent reverting to earlier versions, and third-party apps may become incompatible — the Customer is responsible for reinstalling other software, data and information (not covered). The Product may auto-download and install software updates when deemed necessary. Warranty on a repaired/replaced Product/part continues only for the unexpired Warranty Period. Any extended/additional warranty must be supported by documentary proof. The Company may conduct diagnostic tests to identify causes of failure; only if remote diagnostics are inconclusive should physical products be taken to a service centre or an authorized personnel visit — before returning, back up data and remove confidential/personal information; the Company is not responsible for damage or loss of any program, data or removable media. IoT Devices monitor and relay product parameters and usage patterns via diagnostics; the Company uses these electronic diagnostics to validate warranty claims.

  5. General

No person other than the Company is authorized to make any modification, extension or addition to this warranty. If any term is held illegal or unenforceable, the legality/enforceability of the remaining terms is not affected. This warranty is governed by and construed under the laws of the country in which the Product is issued. Free samples are not covered under warranty. The limited warranty is not transferable from the original Customer to subsequent users.
