JioKrishi is a website-based portal (“Portal”) provided by Jio Things Limited and/or its affiliates (“Company”, “we”, “us”, “our”), located at 101, Saffron, Nr. Centre Point, Panchwati 5 Rasta, Ambawadi, Ahmedabad, Gujarat - 380006, India. The Portal provides services such as information about services offered on the JioKrishi application, using the JioKrishi device, farming tips/advisories and farming news; a demo of the app; reviews by farmers; a link to download the app; and such other services as the Company may provide (“Services”). Your use of the Portal is subject to these Terms and the Portal’s privacy policy; by registering or using the Portal you consent to be bound by them. Use of the JioKrishi device and/or app is additionally governed by their respective terms. These Terms are an electronic record under the Information Technology Act, 2000, published per Rule 3(1) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and require no physical or digital signature.

Modification of Terms: The Company may change the Terms under which the Services are offered, including any charges. The Terms may be modified based on business, legal and regulatory changes and updated online; we will notify you whenever a change is made, and you are encouraged to review this page periodically. Modification of Services: The Company reserves the right to add, modify or delete any content or features in the Services at any time at its sole discretion.

The Portal may contain links to other websites/applications (“Linked Sites”), which are not under the Company’s control; the Company is not responsible for their contents, links, changes or transmitted information, and inclusion of a link does not imply endorsement. Any dealings with third parties (including advertisers) via a link, or participation in promotions — including delivery, payment, and any terms, warranties or representations — are solely between you and the third party, and the Company is not responsible or liable for them. Use of any Linked Site is governed by that third party’s terms and privacy policy. THE COMPANY DISCLAIMS ALL RESPONSIBILITY FOR ANY DISCLOSURE OF INFORMATION OR OTHER PRACTICES OF ANY THIRD PARTY AND ANY WARRANTY REGARDING YOUR INFORMATION COLLECTED, PROCESSED, SHARED OR RETAINED BY ANY THIRD PARTY.

The Company owns title, interest and rights, including all related intellectual property rights, in/of the Portal — including the object code and features of services — protected by applicable laws, except content owned by the user. Such ownership includes all intellectual property rights arising from any suggestions, enhancement requests, recommendations or other information provided by the user, whether in the course of using the Portal, your device or otherwise.

Services are intended solely for availing the Portal’s Services. You may not distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products or Services offered by the Portal. You warrant not to use the Portal for any commercial, unlawful or prohibited purpose, or in any manner that could damage, disable, overburden or impair the Services or interfere with others’ use. You must not use tools/mechanisms (software or hardware) that interfere with the functioning of the Portal or its Services. You may not use the Services/Portal if you have been convicted of any offence under applicable law, or if you are under 18 years of age.

You may be required to register to access the Portal using means provided by the Company. You are responsible for maintaining the confidentiality of any password used to access the Portal, and agree not to transfer passwords/usernames or lend or transfer your access to any third party. You agree to notify us of any unauthorized use of your passwords/usernames or any other security breach related to your account of which you become aware. You are fully responsible for all use of the Portal and Services in connection with your username, except to the extent unauthorized use is not caused by any breach of your obligations under these Terms.

You agree to adhere at all times to the prohibitions in this clause. You must not access the Portal if barred or legally prohibited under Indian law. You shall not host, display, upload, modify, publish, transmit, update or share information that: belongs to another to which you have no right; is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of privacy, hateful, racially/ethnically objectionable, or relates to money laundering/gambling or is otherwise unlawful; is misleading; is patently offensive; harasses or advocates harassment; involves junk/chain mail or spamming; promotes illegal activity; infringes any third-party rights; promotes unauthorized copies of copyrighted work; provides instructions for illegal activities; solicits gambling; harms minors; violates any law; impersonates another; contains viruses or malicious code; or threatens the unity, integrity, defence, security or sovereignty of India or public order. Services may be free or for a specified cost. You are responsible for any third-party access/data fees. Services may check for and require automatic Updates. You agree the information you enter is true, current, complete and accurate; the Company is not responsible for losses arising from discrepancies or unauthorized use of your account. The user agrees the Company may send commercial communication relating to the Services availed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, BUSINESS PROFITS, BUSINESS INTERRUPTION, OR INFORMATION) ARISING OUT OF USE OF OR INABILITY TO ACCESS THE PORTAL, OR FOR ANY SECURITY BREACH, VIRUS, BUG, UNAUTHORIZED INTERVENTION, DEFECT OR TECHNICAL MALFUNCTION, WHETHER OR NOT FORESEEABLE. YOU ARE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ANY EQUIPMENT AND ANCILLARY SERVICES NEEDED TO ACCESS THE SERVICES, AND FOR THEIR SECURITY AND ALL USES. YOU ARE SOLELY RESPONSIBLE FOR CONTENT YOU TRANSMIT AND MUST NOT TRANSMIT CONTENT YOU DO NOT OWN. THE COMPANY MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS OR ACCURACY OF THE INFORMATION, SOFTWARE AND SERVICES, WHICH ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND; THE COMPANY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. THE COMPANY IS NOT RESPONSIBLE FOR UNAUTHORISED ACCESS/ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR FOR ANY THIRD PARTY'S CONDUCT OR INFRINGEMENT. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DAMAGES ARISING FROM USE/PERFORMANCE OF, DELAY OR INABILITY TO USE, OR FAILURE TO PROVIDE, THE PORTAL OR SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE OR STRICT LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY.

Unless otherwise provided, the Services may be terminated by the Company without assigning any reason at any time at its sole discretion. Upon termination/suspension, you shall not have the right to use or access the Portal/Services. The Company reserves the right to suspend and/or terminate your access to the Services in case of any non-adherence to these Terms by you.

These Terms are governed and construed in accordance with the laws of India. The courts in Mumbai shall have exclusive jurisdiction to hear disputes arising out of these Terms.

The Company shall be under no liability whatsoever in the event of non-availability of any portion of the Portal or subscribed content occasioned by act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, failure of any public utility, man-made disaster, infrastructure failure or any other cause beyond the Company’s control.

The Services may be terminated by the Company without assigning any reason at any time at its sole discretion; upon termination/suspension you shall not have the right to use or access the Portal/Services. The Company reserves the right to suspend and/or terminate your access to the Services in case of any non-adherence to these Terms.
